Regulations on conditions for receiving unemployment benefits online

Currently, workers can proactively apply for unemployment benefits online through the National Public Service Portal anywhere without having to go directly to the provincial employment service center. 

To receive unemployment benefits under the unemployment insurance regime, employees must meet the following 4 conditions:

  • Terminated the labor contract or employment contract with the employer in accordance with regulations;
  • Having paid unemployment insurance for at least 12 months within 24 months prior to the termination of the labor contract/employment contract with a fixed term or indefinite term;
  • Have not found a job after 15 days from the date of application for unemployment benefits and are still looking for work;
  • Submitted unemployment benefit application to the employment service center within 3 months from the date of termination of the labor contract/work contract.

Online unemployment insurance application and procedures

1. Online unemployment insurance application

Workers must prepare an online unemployment benefit application including the following documents:

  • Application for unemployment benefits – 1 copy;
  • Employee’s social insurance book – 1 copy;
  • Notarized/certified copy of employee’s CCCD – 1 copy;
  • Original or copy of one of the following documents: 
    • Decision to terminate employment, decision to dismiss or decision to discipline and force termination of employment;
    • Confirmation document from the employer containing specific information about the employee, type of contract signed, reason and time of termination of the labor contract;
    • Confirmation from a competent authority of the dissolution or bankruptcy of an enterprise or cooperative, or the decision to dismiss, remove or remove from office the appointed positions in case the employee is a manager of an enterprise or cooperative.

After preparing all documents, the employee scans all documents in the file into independent files in pdf format.

2. Procedures for receiving unemployment benefits online

Workers can apply for unemployment benefits online on the National Public Service Portal following these steps:

➨ Step 1: Access the National Public Service Portal page

Employees access the National Public Service Portal (National Public Service Portal) at the link https://dichvucong.gov.vn/p/home/dvc-trang-chu. 

➨ Step 2: Register an account on the National Public Service Portal

The procedure for registering a personal account on the National Public Service Portal is as follows: Select “Register” ➔ Select “Citizen” ➔ Select “Mobile subscription” or “Social insurance” ➔ Enter full personal information in the fields marked with * and enter the verification code ➔ Finally, click “Register”.

If you already have a personal account on the National Public Service Portal, skip step 2 and log in to your account as instructed in step 3.

Note:

According to Decree No. 59/2022/ND-CP, from July 1, 2024, employees who want to apply for unemployment benefits online via the National Public Service Portal must log in via the Ministry of Public Security’s VNeID electronic identification account.

➨ Step 3: Log in to your personal account on the National Public Service Portal

Account login steps are as follows: Select “Login” ➔ Select “Account issued by National Public Service Portal” ➔ Enter full ID card/CCCD number, password and verification code ➔ Select “Login” to the account.

After logging in, the OTP code will be sent to your phone message, enter the OTP code then press “Confirm” to complete the login.

➨ Step 4: Select the procedure “Unemployment benefits settlement”

In the search bar, enter the keyword “unemployment benefits” ➔ Select “Resolve unemployment benefits” ➔ Next, select “List of public services”.

➨ Step 5: Choose the agency to handle unemployment benefit applications

Depending on the province or city where you are working and paying social insurance, you choose the agency that handles unemployment benefits, which is the Department of Labor, War Invalids and Social Affairs of the province or the provincial employment service center ➔ Next, select “Submit online” to move to the next step.

Note:

According to statistics from Online Accounting, the provinces receiving and processing unemployment insurance benefit applications online via the National Public Service Portal as of March 25, 2024 include:

  • Ministry of Labor, War Invalids and Social Affairs;
  • Department of Labor – Invalids and Social Affairs of the provinces: Ha Nam, Hai Duong, Hau Giang, Thua Thien Hue, Yen Bai, Dien Bien, Ca Mau, Ho Chi Minh City, Ha Giang, Kon Tum, Phu Tho, Ba Ria – Vung Tau, Binh Phuoc, Bac Kan, Gia Lai, Quang Ngai, Vinh Long;
  • Employment service centers of the provinces: Yen Bai, Thanh Hoa, Bac Kan, Vinh Long.

After selecting, the system will automatically transfer to the public service page of that province, you continue to select “Submit application online”

➨ Step 6: Enter personal information and unemployment benefit application form

In the “Applicant Information” section, fill in all the personal information in the missing fields. Fields marked with * are required.

In the “Detailed Information” section, you fill in all the information in the unemployment benefit application form and select “Continue”.

The information you need to fully fill in the unemployment benefit application form includes:

  • Full name; date of birth; gender;
  • ID card/CCCD number, date of issue, place of issue;
  • Social insurance number;
  • Phone number;
  • Current residence;
  • Select the job position before receiving unemployment benefits, company type, reason for termination of labor contract, type of labor contract…

➨ Step 7: Upload scanned documents to the system

To upload unemployment benefit application documents to the system, click “Choose file” on the right side of the document form and upload.

Once you have uploaded all the documents, click “Continue” to move to the next step.

➨ Step 8: Register for application form and receive results

At this step, you can choose the form of application and receive the results as shown below. Next, select the item “I am sure that the above information is true and agree to be legally responsible for the above declaration” then enter the confirmation code and click “Submit application” to complete the procedure.

3. Notice from the Social Insurance agency after submitting an online unemployment benefit application

After receiving the unemployment insurance application of the employee sent via the National Public Service Portal, the Social Insurance agency will check the application and send the following notice:

➨ Case 1: If the employee’s social insurance book number and one of the two information of full name or ID card/CCCD/passport number do not match the data of the social insurance agency, the provincial social insurance agency will notify the invalid profile via the National Public Service Portal immediately after the employee submits the profile.

➨ Case 2: If the employee’s social insurance number and one of the two information, full name or ID card/CCCD/passport number, match the data of the social insurance agency, within 2 working days, the social insurance agency will send back information about the employee’s social insurance and unemployment insurance payment process via the National Public Service Portal to transfer the online file to the employment service center for settlement.

➨ Case 3: If the employee has not closed the social insurance book, the social insurance agency will send a notice about the unclosed book via the National Public Service Portal to let the employee know.

Time to process online unemployment benefits

1. Processing time at the employment service center

If the profile meets the requirements: Within 16 working days from the date of receiving the employee’s unemployment insurance participation data sent by the Social Insurance agency via the National Public Service Portal, the employment service center staff will review and send the profile of the employee eligible for support to the Department of Labor – Invalids and Social Affairs according to regulations.

In case the application does not meet the requirements: The staff of the employment service center will update the information about the application rejection with an attached document stating the reason for rejection on DVCQG so that the employee is informed.

2. Processing time at the Department of Labor, War Invalids and Social Affairs

Within 2 working days from the date of receiving the application from the employment service center, the Department of Labor, War Invalids and Social Affairs will respond to the employee with the following results:

  • In valid cases, the Department of Labor, War Invalids and Social Affairs staff will update the status “Approved application” and attach the decision to receive unemployment benefits;
  • In case the application is invalid, the Department of Labor, War Invalids and Social Affairs staff will update the status “Application Rejected” and attach a response document to the National Public Service Portal to notify the employee.

Note:

When the application is approved or rejected, the system will send a notification via SMS to the employee according to the phone number that the employee registered with the public service, and display related information and documents on the National Public Service Portal.
