  • Original birth certificate or equivalent documents;
  • Household registration or documents proving residential address;

1. Case of birth certificate registration for abandoned children

Additional documents: Minutes confirming child abandonment issued by competent authority. 

2. Birth registration cases with foreign elements

Additional documents: 

  • Documents proving that the child is residing in Vietnam;
  • Agreement on choosing nationality for children;
  • Passport or documents proving the child entered Vietnam legally;
  • Confirmation document from the competent authority of the foreign country of which the child is a national (*).

(*) If this document is missing, the civil registration office will not fill in the nationality section on the birth certificate and birth registration book.

3. In case of birth registration combined with recognition of father, mother and child

Additional documents: 

  • Application form for adoption;
  • Documents proving parent-child relationship.

Agency receiving documents:

  • If the father, mother and child are Vietnamese citizens: People’s Committee of the commune where the father/mother resides;
  • If the parent/child has a foreign element: People’s Committee at district level where the parent/child who is a Vietnamese citizen resides.

Notes when making birth certificates in special cases

1. In case of not registering marriage, giving birth out of wedlock

If a parent completes the adoption procedure but cannot contact the other parent, the solution is one of the following three ways:

  • Leave the parent’s comments section blank in the birth registration form; 
  • Declare according to birth certificate and identification documents of father/mother (person not directly performing the procedure);
  • The person applying for adoption shall provide information about the other person and shall be responsible for all information provided.

 

2. Case of giving birth during the time of registered marriage

If the parents do not acknowledge the common child or someone else wants to register the adoption, the decision belongs to the People’s Court. 

3. In case of giving birth before the time of marriage registration

A father who wants to adopt a child should note the following:

  • If the mother has completed the birth registration procedure (father’s information is blank): There must be a document confirming the common child and performing the household registration supplement procedure to supplement the father’s information on the birth certificate and birth registration book;
  • If the mother has not completed the birth registration procedure: Only need a document confirming the common child, no need to complete the paternity registration procedure.
