Conditions for doing business in fire protection services
1. Industry and business subjects of fire prevention and fighting services
➤ Business lines of fire prevention and fighting services as prescribed in the Law on Fire Prevention and Fighting amended in 2013, including:
- Trading in fire protection equipment, materials and means;
- Training and guidance on fire prevention and fighting;
- Consulting, design, appraisal, supervision, inspection; construction and installation of fire protection systems; production and installation of fire protection equipment and means.
➤ Subjects permitted to do fire prevention and fighting business according to the provisions of Article 41 of Decree 136/2020/ND-CP, including:
- Individuals doing business in fire prevention and fighting services;
- Fire protection business establishments:
- Business household;
- Vietnamese enterprises;
- Foreign invested enterprises;
- Branches and affiliated units of the enterprise;
- Cooperatives, cooperative unions;
- State-owned enterprises…
2. General conditions for applying for a Fire Prevention and Fighting Practice Certificate
Fire protection services are a conditional business, so to be granted a certificate of eligibility for fire protection business, individuals and businesses need to meet the following conditions.
➤ For fire protection business establishments:
- The legal representative of a fire prevention and fighting service business establishment must have a diploma or certificate of training in fire prevention and fighting knowledge;
- The legal representative of the fire protection service business establishment must be named in the business registration certificate, operating license, or other equivalent documents;
- Have adequate means, equipment and physical facilities to ensure business operations.
➤ For individuals doing fire protection business:
- Individuals must directly participate in the service business activities of the establishment;
- An individual may only use documents and certificates to ensure that a facility is qualified to provide fire protection services;
- Have adequate means, equipment and physical facilities to ensure business operations.
3. Specific conditions for each fire protection business line
In addition to the general conditions for applying for a certificate of eligibility for fire protection business, fire protection business establishments and individuals must meet specific conditions for each industry. Specifically:
➤ Design consulting, appraisal consulting, fire protection supervision consulting:
- Ensure conditions on operating location, facilities, means and fire prevention equipment;
- Have at least 2 employees with fire prevention consulting practice certificates;
- There is at least 1 employee in charge of design, appraisal and supervision of fire prevention and fighting.
➤ Consulting on fire prevention and fighting inspection and testing:
- Have laboratories and testing equipment recognized for quality by competent authorities;
- Have at least 2 employees with certificates of practice in consulting, appraisal/inspection, inspection/supervision of fire prevention and fighting.
➤ Technology transfer consulting, training and guidance on fire prevention and fighting:
- Ensure conditions on operating location, facilities, means and fire prevention equipment;
- There must be at least 1 employee with a university degree in fire prevention or a major in business and has been granted a Fire Prevention and Fighting Training Certificate.
➤ Construction and installation of fire protection systems:
- Have means, machinery and equipment to ensure the construction and installation of fire protection systems;
- There is at least 1 construction commander for fire prevention and fighting.
➤ Production and installation of fire protection equipment and means:
- Have factories, facilities and equipment to ensure production, installation and testing of fire protection equipment;
- There must be at least 1 employee with a university degree in fire prevention or a major in business, and has received at least 6 months of fire prevention and fighting training.
➤ Trading in fire protection equipment, vehicles and materials:
- Have adequate means, equipment and physical conditions to trade in fire prevention and fighting means, equipment and materials;
- Have at least 2 employees with fire prevention and fighting training certificates.
Procedures & documents to apply for a certificate of eligibility for fire protection business
➤ Step 1: Prepare documents
The application for a certificate of eligibility for fire prevention and fighting business includes the following documents:
- Application for certificate of eligibility for fire protection service business (form number PC33);
- Certified copy of business registration certificate;
- Certified copy of diploma, certificate of professional qualifications of legal representative;
- List of individuals with degrees and certificates in fire prevention and fighting suitable for the business field of the enterprise;
- A valid copy of the individual’s employment contract or recruitment decision;
- Documents proving sufficient conditions for fire prevention and fighting equipment, means and facilities.

➤ Step 2: Submit application
When doing business in fire prevention and fighting services, you can submit your application in the following ways:

Note:
Depending on the case, the agency that issues the certificate of eligibility to provide fire prevention and fighting services is different.
The Fire Prevention, Fighting and Rescue Police Department issues the certificate to the following fire prevention and fighting service business establishments:
- Fire prevention and control consulting and inspection;
- Production and installation of fire protection equipment and means;
- Facilities established by decision of the Ministry;
- Foreign invested facilities.
The Fire Prevention, Fire Fighting and Rescue Police Department of the Provincial Police issues the following certificates to fire prevention and fighting service business establishments:
- Facilities in the provincial management area;
- Except for establishments under the jurisdiction of the Department.
➤ Step 3: Receive documents
The competent authority will receive the application, check the composition and validity of the application and implement it according to regulations.
➤ Step 4: Announcement of results
Within 7 working days from the date of receipt of complete documents, the results received from the competent authority will have 2 cases:
- Case 1: Certificate of eligibility for fire protection service business if the documents are valid;
- Case 2: The response document clearly states the reason if the application is invalid.
