What is a CFS certificate of free sale?

For products and goods that want to be exported abroad, it is necessary to apply for a free circulation license (also known as a CFS license – Certificate of Free Sale). 

In other words, the CFS license is a document that both proves that products and goods are allowed to be produced and circulated freely in the exporting country and facilitates the import process. At the same time, through the CFS certificate, the importing country can clearly understand the origin and information of the products and goods.

Before applying for a CFS license, you are required to complete the following two related legal procedures:

1. Announcement of product quality standards – Full package 1,000,000 VND ;
2. Apply for ISO standard certificate, depending on the type of product you can refer to 2 of the following ISO standards:

• ISO 22000 Certificate – Full package 25,000,000 VND ;
• ISO 9001 Certificate – Full package 20,000,000 VND .

➤ Profile details

1. Application for CFS free circulation license includes: 1 English copy and 1 Vietnamese copy;
2. Notarized copy of business license or investment certificate (for foreign invested enterprises);
3. Notarized copy of the announcement of basic standards for products and goods requiring CFS;
4. Other documents depend on the agency responsible for issuing the CFS license (Ministry of Industry and Trade/Ministry of Health/Ministry of Agriculture and Rural Development).

➤ Processing time

Within 5 working days from the date of receiving the application, the competent authority will process and issue a CFS circulation certificate if the application is valid or send a notice of instructions for adjustment or supplementation if the application is invalid. 

➤ CFS Certificate of Free Sale Issuing Authority

Depending on the product or goods, the competent authority issues different CFS certificates. Currently, there are 3 agencies that issue product circulation certificates:

1. Import-Export Department of the Ministry of Industry and Trade, for products and goods such as:  

• Chemicals, industrial explosives;
• Consumer industrial products, food industry, processing industry;
• Types of machinery and equipment with high requirements on labor safety (under the authority of the Ministry of Industry and Trade);
• Other products and goods are not under the authority of the Ministry of Health and the Ministry of Agriculture and Rural Development to issue CFS certificates.

For example: Gasoline, antibacterial towels, instant coffee exported abroad…

2. Ministry of Agriculture and Rural Development, for products and goods such as:

• Raw materials for animal feed production;
• Drugs for the protection of plants and animals;
• Fishing tools and equipment have high requirements for the fisheries industry;
• Chemicals, additives, materials used in agriculture, forestry and fisheries;
• Seeds and products harvested, processed, preserved and transported in the fields of agriculture, forestry, fishery and salt.

3. Ministry of Health, for products and goods such as: 

• Cigarettes;
• Functional foods, nutritional supplements, food additives…;
• Domestic water, drinking water, mineral water…;
• Chemicals, insecticides and disinfectants;
• Medicines, cosmetics and medical equipment.

Regulations on CFS product circulation license

1. The validity period of the CFS product free circulation certificate is specifically stated on the certificate. In case the certificate does not show the validity period, the maximum validity period is 2 years;
2. It is necessary to pay attention to carry out related legal procedures such as announcing basic product quality standards and ISO certification to be able to be granted a CFS product circulation certificate;
3. Currently, CFS certificates are only available in hard copy, so you cannot look up product circulation licenses.
