  2. Notarized copy of 1 of 3 types of licenses:
    • Business registration certificate;
    • Certificate of business registration;
    • Certificate of investment registration.

    • In case of renting processing facilities and warehouses: Contract for renting warehouses, milling, grinding and processing facilities for paddy and rice;
    • In case of owning a processing facility or warehouse: Documents proving land use rights, ownership of warehouses, milling, grinding and processing facilities for rice and paddy.

Procedures for granting certificates of eligibility for rice export business

➧ Step 3: Wait for the certificate of eligibility for rice export business

The time for the Ministry of Industry and Trade to process applications for rice export business licenses is as follows:

  • If the application is valid, within 15 working days, the Ministry of Industry and Trade will issue a rice export business license;
  • If the application is invalid, within 7 working days, the Ministry of Industry and Trade will respond in writing stating the reasons.

Note:

  • Certificate of eligibility for rice export business is valid for 5 years from the date of issue;
  • At least 30 days before the expiration date, traders must submit a request for a new certificate. The procedures and order are similar to those for the first issuance of a rice export business license.

Responsibilities of traders when trading in exported rice

In addition to meeting the conditions for exporting rice, traders need to fulfill the following responsibilities:

  1. Immediately report in writing to the Ministry of Industry and Trade and the provincial Department of Industry and Trade where the trader has a warehouse, milling, grinding, and processing facility for rice and paddy that has been declared to be granted a certificate if:
    • Warehouses and production facilities no longer meet business conditions;
    • There are changes in warehouses and production facilities to meet business conditions.
  2. Report weekly on Thursday to the Ministry of Industry and Trade on the actual amount of paddy and rice in stock by type to synthesize data for management purposes;
  3. Report monthly on the 20th to the Ministry of Industry and Trade on the status of signing and implementation of rice export activities;
  4. Periodic quarterly and annual reports and ad hoc reports as required by competent authorities (*). Specifically:
    • Periodic quarterly reports before the 20th of the first month of the following quarter to the Ministry of Industry and Trade;
    • Periodic annual report before January 20 of the following year to the Ministry of Industry and Trade;
    • Ad hoc reports at the request of competent authorities on the export and production situation, rice prices, production and business situation and other requests for the purpose of rice export management and operation;
    • Report in electronic data file to the Ministry of Industry and Trade (Import-Export Department) via email: phongnlts@moit.gov.vn.
  5. Actively implement the construction of raw material areas according to State policies and report the implementation status to the Ministry of Industry and Trade and relevant agencies.

Note:

(*) Traders shall make ad hoc reports at the request of the Ministry of Industry and Trade, Ministry of Finance, Ministry of Agriculture and Rural Development, People’s Committee, Department of Industry and Trade where the head office, warehouse, production facility or raw material area is located.

In case the trader reports untruthfully or does not comply with the reporting regime as prescribed, he/she will not enjoy preferential policies such as:

  • Participate in trade promotion programs, build and promote images and brands domestically and internationally;
  • Participate in the state’s temporary rice purchase program;
  • Allocate targets for implementing concentrated rice export contracts.
