What is product self-declaration?

Self-declaration of products is the act of individuals/organizations registering and publicly disclosing information about the circulation of products and goods in their business activities with competent state agencies. All information about products and goods will be posted on the Electronic Information Portal.

Regulations on subjects required to self-declare products

Pursuant to Article 4 of Decree 15/2018/ND-CP, individuals/organizations producing and trading food must carry out self-declaration procedures for the following products:

  • Food additives;
  • Food processing aids;
  • Prepackaged processed foods;
  • Packaging materials in direct contact with food;
  • Containers that come into direct contact with food.

Note :

Exemption from self-declaration procedures for products, raw materials for production and import:

  • Only used for production and processing of export goods;
  • Used to serve internal production of organizations and individuals but not for domestic consumption purposes.

Process and procedures for self-declaration of product quality

1. Self-declaration of products and goods

Details of the product self-declaration profile include the following components:

  1. Product self-declaration (form number 01);
  2. Business registration certificate;
  3. Certificate of food safety qualified facility or equivalent documents and certificates;
  4. Copy of manufacturing license (if any);
  5. Copy or original of food safety test results of the product (*);
  6. Declaration of basic standards;
  7. Photo of original image and label of the product to be declared;
  8. Vietnamese sub-label of the product to be declared (if the product is imported);
  9. Other relevant legal documents (depending on each product and goods).

(*): The product’s food safety test result certificate is valid for 12 months. At the same time, the certificate must be issued by a recognized or designated testing laboratory in accordance with ISO 17025 including safety indicators issued by the Ministry of Health.

Note :

Documents in the self-declaration file must be presented in Vietnamese; in case there are documents in a foreign language, they must be translated into Vietnamese and notarized.

2. Procedures for self-declaration of products and goods

According to current law, product self-declaration is carried out in the following 3 steps:

➤ Step 1: Prepare a self-declaration of product quality as fdiinvietnam.com shared

➤ Step 2: Individuals/organizations upload their application to their address and that of the receiving agency.

Specifically, the profile will be posted to:

  • Mass media or electronic information page or public posting at the headquarters of the individual/organization;
  • Announcement on the updated food safety data information system.

In case there is no food safety data information system, individuals/organizations submit 1 set of documents by post or directly to the competent state management agency (*), designated by the People’s Committee of the province/city under the central government to:

  • Record keeping;
  • Post the names of individuals/organizations and names of self-declared products on the website of the receiving agency.

(*) If a product or commodity is manufactured by two or more establishments, the individual/organization is allowed to choose one competent state management agency at the place where the manufacturing establishment is located.

➤ Step 3: Get results

Immediately after self-declaring a product, the individual/organization has the right to manufacture and trade the product and is fully responsible for the safety of that product.

Note :

After the announcement, if an individual/organization changes the product name, origin, or composition, they must re-announce the product. In other cases of change, they only need to send a written notice of the change to the competent authority.
