2. Total number of annual leave days of employees

Pursuant to the provisions of Point a, Clause 1 and Clause 2, Article 113 of the 2019 Labor Code, the number of annual leave days of employees is calculated as follows:

➨ For employees who have worked for 12 months for an employer (NSDLĐ)

The number of annual leave days with full pay is based on the Labor Contract, specifically:

  • People working under normal conditions: 12 working days;
  • Underage workers, disabled people, people doing heavy, dangerous, or toxic jobs: 14 working days;
  • People doing especially heavy, dangerous, or toxic work: 16 working days.

➨ For employees who have worked less than 12 months for an employer

The number of days of annual leave with full pay is calculated proportionally to the number of months the person works.

Thus: Under normal working conditions and working for 12 months at the company, employees will have 12 days of paid leave (2).

Holiday schedule for the year according to the 2025 solar calendar

1. New Year Holiday Schedule 2025

Pursuant to Point a, Clause 1, Article 112 of the 2019 Labor Code, employees are entitled to 1 day off with full pay on the occasion of New Year 2025.

At the same time, Article 13 of the Law on Cadres and Civil Servants 2008 and Article 13 of the Law on Public Employees 2010 stipulate that for cadres, civil servants and public employees, annual leave, holidays and personal leave are also based on labor laws.

Thus: Officials, civil servants, public employees and employees of state agencies will have 1 day off for New Year 2025, which is January 1, 2025 of the solar calendar.

Note:

If the weekly day off coincides with New Year’s Day 2025, employees will be given compensatory weekly day off on the next working day (stipulated in Clause 3, Article 111 of the 2019 Labor Code).

2. Lunar New Year Holiday Schedule 2025 (Lunar New Year)

Pursuant to Point b, Clause 1, Article 112 of the 2019 Labor Code, on the occasion of Lunar New Year (Tet), employees will be entitled to 5 days off with full pay.

Specifically, the 2025 Lunar New Year holiday schedule for employees, cadres, civil servants and public employees is as follows:

➨ For employees, cadres, civil servants, and public employees of administrative agencies, public service agencies, political organizations, or socio-political organizations: The total number of days off for Lunar New Year 2025 is 9 days, specifically from January 25, 2025 to February 2, 2025.

➨ For other workers

Encourage businesses to give employees the Lunar New Year holiday like state officials and civil servants, which means they will also have a holiday from January 25, 2025 to February 20, 2025.

In case the enterprise gives employees 5 days off for Lunar New Year 2025 (the minimum number of days according to regulations), the Ministry of Labor, War Invalids and Social Affairs requires the employer to decide to choose 1 of the 3 following Tet holiday options:

From January 28, 2025 – February 1, 2025 solar calendar 1 last day of the year of the Dragon First 4 days of the year of the Snake

3. Hung King’s Commemoration Day Holiday Schedule 2025

Pursuant to Point e, Clause 1, Article 112 of the 2019 Labor Code, on the Hung Kings’ Commemoration Day, employees are entitled to take a day off with full pay every year on March 10, 2025 of the lunar calendar.

Accordingly, Hung King’s Commemoration Day in 2025 falls on Monday (April 7, 2025), so for cadres, civil servants, public employees and employees who do not work on Saturday and Sunday, they will have a day off from April 5, 2025 to April 7, 2025.

Thus: Officials, civil servants, public employees, and employees of state agencies will have a total of 3 consecutive days off for the Hung Kings’ Commemoration Day 2025 from April 5, 2025 to April 7, 2025.

4. Holiday schedule April 30 and May 1, 2025

Pursuant to the provisions of Point c and Point d, Clause 1, Article 112 of the 2019 Labor Code, every year, employees are entitled to take leave with full pay on the holidays of April 30 and May 1 as follows:

  • Victory Day: 1 day off (April 30);
  • International Labor Day: 1 day off (May 1st).

In Official Dispatch No. 8726/VPCP-KGVX of 2024 of the Government Office, the Prime Minister agreed with the proposal to swap working days on the occasion of the April 30 and May 1, 2025 holidays of the Ministry of Labor, War Invalids and Social Affairs, specifically swapping working days from Friday (May 2, 2025) to Saturday (April 26, 2025) for 5 consecutive days off.

Thus: Officials, civil servants, public employees, and employees of state agencies will have a total of 5 consecutive days off for the holidays of April 30 and May 1, 2025, from April 30, 2025 to May 4, 2025.

5. National Day Holiday Schedule 2025

According to the provisions of Point d, Clause 1, Article 112 of the 2019 Labor Code, on the National Day holiday every year, employees are entitled to 2 days off with full pay, specifically September 2 and the day before or after.

In Official Dispatch 8726/VPCP-KGVX of 2024 on the 2025 National Day holiday schedule, the Prime Minister agreed with the proposal of the Ministry of Labor, War Invalids and Social Affairs to have National Day holiday on September 2 and the day immediately preceding it (September 1, 2025).

Thus: Officials, civil servants, public employees, and employees of state agencies will have a total of 4 consecutive days off for National Day 2025 from August 30, 2025 to Tuesday, September 2, 2025.

Note:

If the weekly day off coincides with a holiday, the employee is entitled to take the weekly day off in lieu on the next working day (stipulated in Clause 3, Article 111 of the 2019 Labor Code).
