Circular 78 and Decree 123 of 2020 on electronic invoices

Decree 123/2020/ND-CP, effective from July 1, 2022, provides detailed regulations on the management and use of invoices, including: electronic invoices with tax authority codes, electronic invoices without tax authority codes, invoices generated from cash registers with electronic data transfer connections to tax authorities, specifically:

1. Forms of electronic invoices

➧ Electronic invoices do not have tax authority codes

An electronic invoice without a tax authority code is an electronic invoice created by the seller and transferred to the buyer without a tax authority code.

➧ Electronic invoice with tax authority code

An electronic invoice with a tax authority code is an electronic invoice that is coded by the tax authority before the seller transfers it to the buyer. Accordingly, the tax authority code includes the transaction number and a string of characters, automatically issued by the tax authority system to ensure no duplication.

➧ Invoices are generated from the cash register

Invoices generated from cash registers with electronic data transfer connections to tax authorities are a form of electronic invoice with tax authority code and electronic invoice without tax authority code.

2. Regulations on converting electronic invoices

In order to optimize costs and time in creating, storing, looking up invoices as well as reporting and declaring taxes compared to paper invoices, the General Department of Taxation has officially piloted the conversion of electronic invoices with tax authority codes in 6 major provinces and cities such as Ho Chi Minh City, Hanoi, Hai Phong, Quang Ninh, Binh Dinh, and Phu Tho.

Accordingly, the mandatory time to use electronic invoices is stipulated as follows:

  • Before July 1, 2022: Compulsory use of electronic invoices for businesses that receive notice from tax authorities and meet information technology infrastructure requirements;
  • From July 1, 2022 onwards: Mandatory use of electronic invoices for organizations, businesses, business households, and individual businesses.

1. How to register for electronic invoices with and without tax authority codes

To register to use electronic invoices online (for electronic invoices with and without tax authority codes), follow these steps:

  • Step 1: Access the General Department of Taxation’s electronic information portal;
  • Step 2: Fill out the electronic invoice registration form (form number 01);
    At “Apply electronic invoices”, check (✓) the type of electronic invoice you want to register to use: with or without a tax authority code.
  • Step 3: The tax authority will send a notice of results within 1 working day.

Note : Cancel all unused paper invoices (even if invoice issuance has been notified) before switching to using electronic invoices with tax authority codes.

2. How to handle incorrectly written electronic invoices

>> In December 2021, the following 6 provinces and cities must apply electronic invoices according to Decree 123, and simultaneously cancel all old unused invoices: Ho Chi Minh City, Hanoi, Hai Phong, Quang Ninh, Binh Dinh, Phu Tho.

>> From July 1, 2022, the whole country must simultaneously switch to using electronic invoices and cancel all unused paper invoices (even if the invoice issuance notification procedure has been completed).
